Getting Help with Your ICBC Claim

In the aftermath of any car accident you will be required to make a claim through the Insurance Corporation of British Columbia (“ICBC”). Making a claim through ICBC can be a confusing and difficult proposition. You may have little understanding of the procedures involved or your legal rights in the matter, and you may be asked by ICBC to sign statements and documents without fully understanding what they mean and how they may affect your claim. What to Do After a Car Accident

Following any accident, you should immediately seek medical attention, either through your family doctor, a walk-in clinic or a hospital. It is also critical that, if your injuries are visible, photos are taken for documentation purposes. These will be helpful for your ICBC claim. Within 30 days after the accident, you will need to submit a written statement to ICBC describing the accident and your injuries. Also, within 90 days after the accident, you will need to apply to ICBC for accident benefits (also sometimes called “Part 7 No Fault Benefits”) in order to receive contribution from ICBC towards the cost of your post- accident therapy (for example, physiotherapy and/or massage).

The monetary award that you may ultimately recover from an ICBC claim may include compensation for various categories of costs or losses, including:

  • loss of wages (including any potential future wage loss);
  • the cost of any future medical care that you may require;
  • loss of enjoyment of life (also known as “pain and suffering”);
  • any out-of-pocket expenses that you may have incurred as a result of the accident and your injuries; and
  • compensation for family members who were required to provide assistance to you because of your injuries.
